1. Introduction

These Terms of Service (“Terms”) govern the use of McSill Ultra 5.0 (“McSill Ultra”, “the Plugin”, “we”, “us”, or “our”), a storytelling, narrative development, analysis, and editorial assistance plugin based on the methodology and intellectual work of James McSill.

By accessing or using McSill Ultra 5.0, you agree to these Terms and to the applicable terms and policies of the platform through which the Plugin is accessed, including OpenAI services where applicable.

If you do not agree with these Terms, you should not use McSill Ultra 5.0.

2. Purpose of McSill Ultra 5.0

McSill Ultra 5.0 is designed to assist users with storytelling, narrative development, writing, analysis, editing, and related creative and editorial activities.

Its capabilities may include assistance with:

narrative structure and story development;
manuscripts, chapters, scenes, and sequences;
characters and character development;
dialogue and subtext;
point of view and narrative perspective;
emotional progression;
tension, conflict, and pacing;
reader experience;
fiction and non-fiction;
professional and educational narratives;
editorial analysis and revision;
development and exploration of ideas;
application of McSill storytelling methodologies and commands.

McSill Ultra 5.0 is an assistance tool. It does not replace the judgement, responsibility, or creative decisions of the user.

3. Eligibility and Platform Requirements

Use of McSill Ultra 5.0 is subject to the eligibility requirements, account requirements, age restrictions, geographical availability, and other conditions imposed by OpenAI or any other platform through which the Plugin is made available.

Users are responsible for maintaining access to the necessary platform and complying with its applicable terms and policies.

4. User Content

Users may submit manuscripts, stories, scenes, ideas, notes, images, instructions, and other materials (“User Content”) for processing by McSill Ultra 5.0.

Users retain their rights in their original User Content, subject to the applicable terms of the platform through which the Plugin is accessed.

Use of McSill Ultra 5.0 does not, by itself, transfer ownership of a user’s original manuscript, story, idea, or other original material to James McSill or McSill Ultra 5.0.

Users are responsible for ensuring that they have the necessary rights, licences, permissions, and legal authority to submit and use any content provided to the Plugin.

5. Intellectual Property

The McSill Ultra 5.0 name, its proprietary methodologies, instructional structures, command systems, documentation, original materials, branding, and other intellectual property associated with the Plugin may be protected by copyright, trademark, or other applicable intellectual property rights.

Except where expressly permitted, these Terms do not grant users ownership of the McSill methodology, McSill Ultra systems, proprietary documentation, branding, or other intellectual property belonging to James McSill or the applicable rights holder.

Users may use outputs generated through their lawful use of the Plugin subject to applicable law, these Terms, and the terms of the platform through which the Plugin is accessed.

6. Acceptable Use

Users must use McSill Ultra 5.0 lawfully and responsibly.

Users must not use the Plugin to:

violate applicable laws or regulations;
infringe the intellectual property or other rights of another person;
submit material they are not authorised to use;
attempt to gain unauthorised access to systems, services, accounts, or information;
interfere with the operation or security of the Plugin or its supporting platforms;
circumvent technical, access, security, or usage restrictions;
extract, reproduce, redistribute, reverse engineer, or commercially exploit proprietary McSill Ultra methodologies or internal materials except where expressly permitted by law or written authorisation;
falsely represent output generated with assistance from the Plugin in a manner that violates applicable law or platform policies.

Use of McSill Ultra 5.0 is also subject to the applicable usage and safety policies of OpenAI and any other platform through which the Plugin is accessed.

7. AI-Generated and AI-Assisted Output

McSill Ultra 5.0 uses artificial intelligence to provide analysis, suggestions, transformations, and other forms of assistance.

AI-generated or AI-assisted output may contain errors, omissions, inconsistencies, or unsuitable suggestions.

Users are responsible for reviewing, verifying, editing, and deciding whether to use any output.

No output should automatically be regarded as factually correct, legally authoritative, professionally certified, or suitable for publication without appropriate human review.

8. Editorial and Creative Responsibility

McSill Ultra 5.0 is intended to extend and support the user’s creative process, not replace it.

The user remains responsible for:

creative decisions;
factual accuracy;
originality;
permissions and licences;
final editorial decisions;
publication decisions;
compliance with applicable laws;
consequences arising from the use or publication of their work.

Recommendations provided by the Plugin are advisory rather than mandatory.

9. No Guarantee of Results

McSill Ultra 5.0 does not guarantee publication, commercial success, literary recognition, audience growth, sales, awards, professional acceptance, or any other specific outcome.

Narrative and editorial recommendations necessarily involve creative judgement and may not be appropriate for every work, audience, genre, or purpose.

10. Confidential and Sensitive Material

Users should exercise appropriate judgement before submitting confidential, commercially sensitive, legally privileged, or highly sensitive personal information.

The Plugin should not be treated as a confidential document repository unless the platform and service configuration being used expressly provide the security and confidentiality protections required by the user.

11. Availability and Changes

McSill Ultra 5.0 may be modified, improved, expanded, restricted, suspended, or discontinued.

Features and capabilities may change as the Plugin, the McSill methodology, artificial intelligence technology, or the underlying OpenAI platform evolves.

Continuous or uninterrupted availability is not guaranteed.

12. Third-Party Platforms and Services

McSill Ultra 5.0 currently operates within technology environments provided by third parties, including OpenAI.

The availability and operation of those services are governed by their respective terms, policies, technical requirements, and service conditions.

We are not responsible for outages, restrictions, changes, or other events caused by third-party platforms that are outside our reasonable control.

13. Privacy

Use of McSill Ultra 5.0 is subject to the McSill Ultra 5.0 Privacy Policy.

The Privacy Policy explains how information associated with use of the Plugin is handled and distinguishes between processing associated with McSill Ultra 5.0 and processing performed by OpenAI or other applicable service providers.

14. Disclaimer

To the extent permitted by applicable law, McSill Ultra 5.0 is provided on an “as is” and “as available” basis.

We do not warrant that the Plugin will always be available, error-free, complete, accurate, or suitable for every particular purpose.

Nothing in these Terms excludes or limits rights or protections that cannot lawfully be excluded or limited.

15. Limitation of Liability

To the maximum extent permitted by applicable law, James McSill and the applicable operator of McSill Ultra 5.0 shall not be liable for indirect, incidental, consequential, special, or similar losses arising solely from reliance on AI-generated or AI-assisted output or from circumstances outside their reasonable control.

Nothing in these Terms excludes or limits liability where such exclusion or limitation is prohibited by applicable law.

16. Suspension or Termination

Access to McSill Ultra 5.0 may be restricted or terminated where necessary to address unlawful activity, abuse, security concerns, material violations of these Terms, or requirements imposed by the platform through which the Plugin is distributed.

17. Changes to These Terms

These Terms may be updated to reflect changes in McSill Ultra 5.0, its functionality, applicable laws, platform requirements, or business practices.

The “Last updated” date at the beginning of these Terms identifies the latest revision.

Continued use following an update may be subject to the revised Terms, in accordance with applicable law.
